Anyone involved in a patent dispute initially thinks of lengthy court proceedings, high costs and an uncertain outcome. Since mid-May, a new option has been available, and it could fundamentally change the landscape of European patent disputes.

What is the PMAC?

On May 12, 2026, the Patent Mediation and Arbitration Centre (PMAC) officially began operations at the Unified Patent Court (UPC). The PMAC was established under Article 35 of the Agreement on the Unified Patent Court (UPCA), which is currently in force in 18 EU member states, and is an independent, specialized institution for alternative dispute resolution (ADR) in patent matters. The center is based in Ljubljana and Lisbon.

What procedures are offered?

The PMAC covers a wide range of dispute resolution methods: it offers mediation, arbitration, and expert determination, also for cross-border disputes and for FRAND cases involving standard-essential patents.

Mediation services have been available since May 12, 2026; the UPC referred its first case to the PMAC on May 13. Arbitration and expert determination are expected to follow later in 2026. 

How does the process work in practice?

Since May 12, 2026, the PMAC’s digital Case Management System (CMS) has been operational, allowing requests for ADR proceedings to be submitted electronically. The system is supplemented by step-by-step instructions, training materials and FAQs on the PMAC website. 

What does this mean for patent holders and companies?

For many companies, litigation with the UPC involves considerable effort. The PMAC now offers the opportunity to resolve disputes more quickly, confidentially, and cost-effectively, without having to forego the expertise of specialized professionals. The new service is particularly relevant for cross-border licensing disputes as well as for disputes involving standard-essential patents.
